Steps to Buy Property in Quintana Roo, Mexico

Step 1

Choose your dream home

Choose the Property: Find the property you like and agree on the price.
Make an Offer: Submit a written offer and negotiate terms.
Sign the Purchase Agreement: Both parties sign a contract and the buyer pays a deposit (usually 5–10%).
Due Diligence (2 to 4 weeks): The notary reviews the property’s legal status, permits, debts, and ownership. This step usually takes 2 to 4 weeks.
Set Up the Trust (for foreigners): Foreign buyers need a bank trust (fideicomiso) or a Mexican company. This can happen at the same time as due diligence.
Final Payment (4 to 6 weeks total after step 3): Pay the balance once everything is cleared.
Closing at the Notary: Sign the final deed, pay closing costs, and register the property.
You Get the Keys! Property is now legally yours.

How Can a Foreigner Buy in Mexico?

Most foreign investors find the buying process in Mexico to be an extremely professional and pleasant experience!

The most important part of this process is to make sure that you are represented by experienced people, such as your realtor and lawyer. In Mexico, it is always wise to ask for referrals to find the most qualified person to represent you.

How Do I Purchase Property in Mexico?

A foreigner can purchase property located within 100 kilometers of any border or within 50 kilometers of the coastline through a Bank Trust (Fideicomiso).

Bank Trust (Fideicomiso)

For all residential / tourism property

The Bank Trust (Fideicomiso) is a trust agreement that you establish with a bank to hold the title to a property (both you and the bank are named in the title documents). This trust deed ensures foreign property buyers have all the rights and privileges of ownership.

Advantages of the Bank Trust:

Allows the property owner to hold the property in perpetuity.
The fideicomiso is a 50-year trust agreement that is renewable every 50 years by you or your heirs.
You can transfer your rights in the fideicomiso to another foreign buyer.
One contract can hold more than one property in the same deed.
You may rent, sell, or remodel the property.
Your heirs can inherit the rights to the fideicomiso, effectively bypassing probate.
There are tax advantages related to capital gains when you sell.
The fideicomiso is easy to maintain with an annual fee paid to the bank.

Notary Fees: 1% – 1.5% of property price
Transfer Tax: 3% of property price
Registration Fees: ~0.5%
Trust Setup (Fideicomiso, if foreigner): $2,000 – $2,500 USD (one-time)
Annual Trust Fee: ~$500 – $700 USD per year
Legal Fees: ~$1,500 – $3,000 USD (if you hire a lawyer)
Appraisal & Certificates: ~$500 – $1,000 USD
